Pumpkin Web Design Ltd – Terms & Conditions

Last updated: August 2025

Design & Development

We design websites that adapt to different devices and screen sizes. We work iteratively using WordPress and customisable themes, so we won’t mock up every single page. Instead, we’ll use visual references to indicate direction (colour, typography, etc.) – we call this ‘atmosphere.’

Your designs will always be tailored to your business requirements, and you’ll have plenty of opportunities to review our work via a private development link. We’ll stay in regular contact throughout via phone or email.

If, at any stage before the website is officially launched (i.e. made live and visible to the public), you decide to change direction or cancel the project, we’ll invoice you for the time we’ve spent to date. This contract can then be terminated with no hard feelings.

Text Content

Unless stated in our agreement, we’re not responsible for producing your website text. However, we do offer professional copywriting and editing services – ask us for a quote.

From time to time, we may use AI-assisted tools to support content ideation or SEO. All final content is reviewed by a human, but we make no guarantees about originality or fitness for legal or regulatory purposes unless specifically scoped.

Graphics & Photography

You’ll need to provide high-resolution digital images and editable graphic files where applicable. If you don’t have imagery, we can use our limited library of copyright-free assets or purchase stock imagery on your behalf. If this exceeds our reasonable allocation, we’ll provide a quote for further stock image purchases.

Code & Technology

We build using WordPress and standard technologies such as HTML, CSS, JavaScript, PHP and MySQL. We can’t be held responsible for future changes to third-party platforms, plugins or codebases. Compatibility issues or software updates may require additional work or support at a later stage.

We are not liable for issues caused by third-party plugins or tools used on your website, even after launch. These are outside our control, but we will always try to help resolve issues where possible.

Browser & Device Testing

We test websites in current versions of major browsers: Safari, Chrome, Firefox, Edge and Opera. We do not test older or obsolete browsers.

We test mobile responsiveness using modern iOS and Android browsers (Safari and Chrome). We do not test niche or deprecated mobile browsers (e.g. Opera Mini).

Accessibility

We build with general accessibility in mind (semantic HTML, readable fonts, scalable layouts), but unless explicitly requested, we do not guarantee WCAG 2.2 or legal accessibility compliance. If full accessibility compliance is important to your organisation, please let us know during project scoping.

Changes to Your Original Brief

We understand that ideas evolve. The original project cost is based on your brief at the time of agreement. If you’d like to change or add features, that’s no problem – we’ll provide a separate estimate for the additional work.

Support

Your website will need maintaining and updating. Most clients find this daunting – that’s why we offer flexible support plans. These typically include content edits, plugin updates, SEO tweaks, backups, and general WordPress help.

We reserve the right to quote separately for work that falls outside of fair usage. We cannot guarantee the ongoing stability of your website due to the nature of third-party software (WordPress, themes, plugins, hosting). But we’ll always do our best to put things right.

As your needs grow, your support requirements may grow too. We may adjust our fees accordingly, with prior discussion.

Hosting & Email

We are not a hosting company. We can recommend or configure hosting through trusted providers (e.g. Catalyst2 or Fasthosts), but we accept no liability for hosting-related issues, including:

  • Website downtime
  • Loss of content or files
  • Email disruptions or errors
  • Revenue losses or reputational damage caused by hosting failures

Hosting and email are the client’s responsibility unless stated otherwise.

Search Engine Optimisation (SEO)

We build websites with search engines in mind – fast-loading, mobile-friendly, accessible code and on-page optimisation. However, we cannot guarantee Google rankings, traffic improvements or search visibility.

Search engine algorithms change frequently, and results depend on many external factors including your content, backlinks, competition, and market conditions. We offer SEO services, but outcomes are not guaranteed.

Client Responsibility for Legal & Regulatory Compliance

It is the client’s responsibility to ensure that all website content complies with relevant regulations, including:

  • UK GDPR and privacy laws
  • Healthcare or financial advertising rules (e.g. ASA, CAP, GMC, FCA)
  • Accessibility requirements

We can advise where appropriate, but legal responsibility lies with you unless we have explicitly agreed to manage compliance in writing.

Performance & Web Vitals

We aim to build efficient, user-friendly websites. However, we do not guarantee specific Google PageSpeed Insights or Core Web Vitals scores unless scoped as a separate performance optimisation project.

Third-Party Tools & Integrations

We may recommend or install third-party services such as booking tools, analytics, or social media feeds. These are not owned by us and may change or break without notice. Maintenance, costs and data compliance for these services are your responsibility.

GDPR & Data Collection

Where websites include forms or data capture, you are responsible for:

  • Providing an accurate privacy policy
  • Implementing cookies consent tools if needed
  • Handling enquiries or data in line with UK data protection laws

We can help set up privacy tools, but full compliance remains your responsibility.

Force Majeure

We’re not liable for delays or issues caused by events outside our control, including (but not limited to): natural disasters, internet outages, strikes, pandemics, or third-party failures.

Final Word

We’re a friendly, transparent team and will always work hard for you. These terms are here to keep things fair and protect everyone involved. If you ever have questions, just ask!
